The Sound Cellar is a huge fan of the great TV show Pawn Stars on The History Channel. And, our favorite character on the show is Chumlee. We get the biggest kick out of him. We were thinking the other evening that maybe, just maybe Chumlee would make a great President of the USA. Searching the net using "Chumlee for President" to see if anybody else agreed with us, we came upon this very cool T-shirt on Cafe Press. And, a couple of clicks later we found a bunch of "Chumlee for President" stuff. So, our Christmas shopping just got easier and we are going to start the campaign, Chumlee for President, 2012!

Ron escaped from the band of rogue disco fans on Saturday night. The Intrepid Weather Babe delivered the ransom, a near mint copy of a Saturday Night Fever vinyl LP and a disco ball complete with motor. What the Disco fans didn't know is that the Intrepid Weather Babe hid a copy of The Rolling Stones single Street Fighting Man in the sleeve. Ron was forced to play DJ for these crazed disco fans late into Saturday night. Suddenly Ron played the Stones' single and as the disco fans put their hands to their ears, grimaced in pain and writhed on the floor, Ron made his way out of the warehouse where he was being held hostage. Authorities were called and all of the disco fans that held Ron hostage were apprehended and are being held on various charges - the biggest charge being "having very poor taste in pop music." Ron's Picks will return next week.

The Sound Cellar now features over 2,100 cuts in our music library.

Our "Over Easy" program's library has grown to 56 hours of free form music from a variety of sources. All of the old favorites are there mixed in with an eclectic selection of independent artists playing various genres. This program has really grown and is a great way to get your weekday started or is a nice soundtrack for Sunday morning cooking, coffee and newspaper reading.

If you just can't stand the thought of the weekend coming to an end, "Sunday Night Rock" might just be the ticket - nothing but hard driving rock and roll from 9 PM EDT until 5 AM Monday morning.

The record store has been an important part of my life and it's a real kick to have a special day to enjoy and acknowledge the independent record store. With the advent of digital madness, history has forgotten how record stores were responsible for providing music of all genres for public consumption thereby spreading culture and entertainment throughout our communities. Life would not have been the same without The Record Store.

The Sound Cellar encourages you to sign the petition to reinstate Hank Williams into the Grand Ole Opry.

He was the first Grand Ole Opry artist to be called back for six encores. In 1952 Hank was booted out of the Grand Ole Opry for being too drunk to perform. Hank made a promise to sober up and make amends so he could make his return to the Opry, but his life was tragically cut short and he never had the chance to make things right.

Nowhere In Time

The Sound Cellar presents a new weekly show, "Nowhere In Time." At one and a half hours, the show will present a wide array of music of various genres. There is no format. There is no formula. Please spread the word about this great new show.

The first part of the premiere show for the week of February 4, 2008 features artists from the mid 1980's on the 4AD label. An excellent history of the first twenty years of 4AD can be found at this website. The second part of the show features a variety of artists - Garage A Trois, Richard Barbieri, Bobby Previte, Pink Floyd, The Beatles, Robyn Hitchcock and the Venus 5 and others.

New Show and Christmas Broadcasts

Hey, hey!

The Sound Cellar has a new show, "The Rhythm." It features classic soul and rhythm and blues hits. This show is for the weekend Night Owls in the eastern time zone and it also kicks off the weekend late Friday afternoon.

Here's a link to The Sound Cellar's revised broadcast schedule. Adjust the time zone on the schedule page as required.
Note that our shows "FM" on Friday night and "Classic Rock" on Saturday night now broadcast until midnight. And, "FM" now goes until 11:30 PM Monday through Thursday. Our "Trademark Oldies," including soul and rhythm and blues, and "Over Easy" shows are proving to be pretty popular. When our special programs are not running The Sound Cellar features a free form mix of classic rock, oldies, soul and rhythm and blues. We really want to do a regular live broadcast and are still working out the schedule. We are kicking around some ideas and when we get the details worked out we'll send out some information. There has been a lot of interest expressed about us doing this. I can promise you this, when it happens the broadcast will not be formulaic.

The Christmas broadcasts were a huge success. The Christmas Eve live broadcast was so big we had to move it to Bop City to accommodate more listeners. And the 24/7 Christmas broadcast on the Sound Cellar had the biggest audience of any broadcast that we've ever hosted. From the statistics that we are able to get, it appears like we had over 850 listeners total for all of our Christmas broadcasts. We are hoping that we've gained some regular listeners from our Christmas broadcasts.

A big thanks to Francesca Jarosz of the Indianapolis Star who wrote a great article on the history of our Christmas broadcast. For those of you that haven't read the article, here's the link. Obviously the article had a huge impact on the number of listeners that we had for our Christmas broadcasts. Every day Francesca keeps Indy's northsiders and Carmel residents informed with her reporting in the Indianapolis Star and we thank her for that as well.

The top five U.S. metro areas, after Indy who remains firmly at number one, that have listened to The Sound Cellar in the last 30 days are Louisville, Washington D.C. (you know who you are...), Philly, Honolulu and Miami. Honolulu and Miami......those spots sound real good about right now, maybe a remote broadcast is in order?

Our international listenership has fallen off a little as of late but the top three countries from the last 30 days are Brazil, Bulgaria and Canada.

We're working on some more promotion ideas and all of you good people should feel free to spread the word about The Sound Cellar.

The Sound Cellar, is celebrating the Holiday Season in a big way. We are playing an eclectic collection of Christmas music from a collection that we have amassed over the last fifteen years. There are rarities, curiosities and some old favorites in the broadcast. Some of our favorites this year are Tiny Tim's version of I'm Dreaming of a White Christmas, Nancy White's It's So Chic to be Pregnant at Christmas, Debbie Dabney's I Want to Spend Christmas with Elvis and Kay Martin and her Bodyguard's All I Want for Christmas is a Casting Couch.

The Sound Cellar's Christmas show is very popular and has been known to spice up a Christmas party or two. Please join us for the broadcast and have some fun with The Sound Cellar this Holiday Season!

Artist of the Month - Heart

The Sound Cellar's artist of the month, maybe two, is the classic rock band Heart. Head over to The Sound Cellar's featured artists and albums blog for more in depth information about Heart's newest release and Ann Wilson's new solo album.

There probably was not a show where I didn't play at least one song from Dreamboat Annie or Little Queen when I was a jock and the music director at a college radio station from 1976-1978. Upon, learning that Heart had recently recorded their classic album Dreamboat Annie live thirty years after the album's initial release renewed my interest in Heart. I had watched Heart's performance on Soundstage a couple of years back and was very impressed. They still had that thing that made them special. They have the songs, the musicianship and the stage presence to be one of the most exciting bands in the history of rock and roll. They were always able to transcend the fact that they are a band that is fronted by two women. This was not a girl band; Heart always has been a rock and roll band.

The newly released Dreamboat Annie concert is more than just a live rendition of the album. It possesses an energy in the performance that comes from the fact that Ann and Nancy Wilson and the rest of the band believe in the music. The inclusion of the Stockholm strings is a nice touch and adds a fresh dimension to the performance. Ann is in excellent voice and has never sounded better. Nancy's playing and background vocals are top-notch. Her stage presence is alluring, as it has always been. The inclusion of a selection of classic rock tunes that were inspiration for Heart's music, as the encore pulls the entire show together. Their versions, while faithful to the originals, have the Heart stamp firmly applied.

The recording comes in two formats, a CD and a DVD. These are essential recordings for Heart fans and fans of the era of classic rock that started in the 1970's.

Ann Wilson's first solo album Hope and Glory is a collection of rock and roll songs that are "socially conscious." Neil Young, John Lennon and Bob Dylan are covered. An original, "Little Problems, Little Lies" concludes the album with a strong message in this time of war. The two outstanding tracks are Led Zeppelin's "Immigrant Song" and Dylan's "A Hard Rain's A-Gonna Fall." Ann's take on Neil Young's "War of Man" is haunting. This record is not a derivative of Heart. It is a fully realized solo endeavor with its own vibe. It's not all rock and roll. Ben Mink's production is top notch and is sympathetic to the songs and melds the instrumentation incredibly well with Ann's vocals. There are several guests on the album including Ann's sister Nancy, Elton John, Rufus Wainwright, kd lang and Alison Krause. This album is a well crafted and thought out effort that holds together well and has a message that it delivers indeed with Hope and Glory. Recommended.

There has been an ebb and flow of events surrounding the plight of internet radio over the last few months. We are still essentially at a standstill. I really don't feel like going into all of the details, but basically what is happening is that the negotiations with Sound Exchange are pretty much of a joke. They put small webcasters out of business in about three years and the only way the big boys get a break is if they only play those artists represented by Sound Exchange. The Internet Radio Equality Act will be the only saving grace, and right now it appears to be doomed and headed into the black hole of United States Congress inaction.

The bottom line is that the freedom and opportunity that was supposed to be the future of the internet is coming to an end as the corporate world is throwing its political influence, money and lawyers around. If Net Neutrality is not supported and upheld, it's all over. Big business will have won and effectively neutered the internet for their profit.

Now for some music news. John Fogerty, Neil Young and Bruce Springsteen all have new records coming out in early October - I guess it's ol' fogey rocker month... The Sound Cellar is featuring cuts from these new albums. Rumor is, from those who have heard it, Springsteen's new album promises to be a keeper. Internet Radio - Still Alive

Today, July 15, 2007 was supposed to be the day internet radio died. Thanks to actions from listeners from around the world and a hard line by Live365, we're still streaming classic rock, oldies and with a touch of rhythm and blues to the world.

Live365 has decided that they are not going to pull the plug today. By standing firm, they were going to force Sound Exchange's (SX) hand to use the legal system to shut them down. Sound Exchange and their associated culprits realized that they could not withstand the public outcry if they took legal action against live365 and backed off.

Congress has stepped in with a temporary bill delaying the new performance royalty rates for sixty days so that negotiations can continue between SX and webcasters. Essentially, all parties were called onto the carpet by Congress and a round-table discussion was held in Washington D.C. with various members of Congress and several webcasters. This was a very good thing as SX had been very busy with a strategy of propaganda consisting of half-truths being relayed to Congress and the public. When the details of any proposal that SX had made were uncovered, it was discovered that their "deals" were completely disingenuous and unworkable. One of their offers even required webcasters to give up their rights to pursue existing and future legislation with regard to royalty rates - nothing like dealing with a little extortion while "negotiating."

Distilled, all of this mess comes down to nothing more than a huge effort to not allow control of the distribution of music on the internet by a small contingent of corporations that are only interested in their bottom line. This is a struggle of music lovers versus bean counters and lawyers. This has become more than just about "internet radio."

The folks that stand to lose the most if internet radio goes away are the artists. If the major labels take over internet radio, artists will no longer see performance royalty checks as the labels will direct license their music to label associated stations (see what is happening at last.fm). And, they will lose one of the their only outlets for playing their music for the public's discovery. Independent artists and artists with small audiences will lose big time.

Realizing that satellite radio pays performance royalties as a percentage of revenue and over-the-air radio pays no performance royalties, there are still inequities to be worked out within the scope of the Internet Radio Equality Act (IREA). This fact cannot be ignored.

In summary, it looks like SX's propaganda campaign strategy didn't work. So we're continuing full speed ahead. We're planning some changes at The Sound Cellar which will add more specialty programming.

The Sound Cellar In The News

Erika D. Smith wrote an excellent article on the plight of internet radio in the Indianapolis Sunday Star. I was interviewed for the article and Erika included a couple of quotes from our discussion.

The demise of internet radio at the hands of the RIAA and the major labels may well be at hand. If this does happen they will have succeeded in making millions of their customers incredibly upset and the world will have lost an exceptional cultural asset. The music business, what's left of it, will have changed forever in ways that will not be apparent for some period of time. The artists, that have mostly remained silent throughout this fiasco, are the biggest losers. They will have lost an incredibly valuable promotional and distribution outlet.

It may seem like I'm being overly dramatic about all of this, but I really do believe that once the major labels control music distribution on the internet all will be lost. These folks are lawyers and bean counters. They aren't music people. They don't care about how music can enrich lives, how artists can inspire, how music can be an escape from every day drudgery, how music can lift our spirits in times of trouble... all they care about is moving units and maximizing profits. A perfect example of how badly all of this is going, and has gone, is what Mr. Bronfman Jr. has done to the once great Warners Music.

Internet radio is run by music lovers that want to share that love with the rest of the world. In this day and age, this just cannot be allowed.

Que sera sera.

Here's hoping for nothing short of a miracle before July 15, 2007 - the day the music dies.

A side note to Erika's article...

Something to keep in mind regarding these supposed negotiations between webcasters and SX as requested by Congress...

From RAIN:

One important point to keep in mind, as webcasters are discussing today, that a direct settlement between SoundExchange and webcasters -- what the Small Business Committee (and most of Congress, I'd assume) says it wants -- would only cover the minority of recording artsits for whom SoundExchange is authorized to negotiate. This is not the intended result of a "one-license-to-cover-it-all" statutory rate.

Therefore, Sound Exchange is not able to negotiate blanket royalty rates. So the negotiations that Congress requested Webcasters and Sound Exchange engage in are essentially worthless, unless a webcaster only wants to play the music that Sound Exchange will allow them to play. (Sounds like socialism has come to internet radio - this is what you have to play and this is what you have to pay us to play what we tell you you can play.) This is what it's come to...

Day of Silence - June 26, 2007

Well, time is running out. Desperate times calls for desperate measures. To call attention to our plight, tomorrow, June 26, 2007, will be a day of silence for internet radio.

The Copyright Royalty Board in conjunction with Sound Exchange, the RIAA and the major music labels have all but colluded to put internet radio out of business by setting completely stupid royalty rates that result in more money due to Sound Exchange than most internet radio businesses gross. They are content to ruin businesses and livelihoods and, not to mention, put many, many folks out of a job for their own self serving greed. If the culprits have their way independent artists, artists with smaller audiences and many genres, like classic jazz, will lose a valuable outlet for their music. Internet radio currently pays royalties to artists and their record labels. Over the air radio does not and satellite radio pays a much smaller rate that does internet radio. So artists not only stand to lose airplay but income.

Internet radio will become an outlet for the latest thing from the major music labels. They won't pay the artists any royalties for the airplay, they'll just try to sell music product that will line their pockets. Ask any major label artist how much money their record company pays them for music sales. Roger McGuinn once told me he has never made a penny from sales of his Columbia label recordings with The Byrds... think about that!

On July 15, 2007 internet radio may very well cease to exist. There is legislation in both the U.S. Senate and the House of Representatives that would enable internet radio to continue to bring the world an assortment of music genres that is unparalleled. A hearing is scheduled in the House but time is running out. The bills have been languishing for over two months. The only way the legislation is going to get legs is for the listening audience to rise up and be heard. If you do not want the major labels controlling the internet's music content please contact the House and Senate and tell them to get the Internet Radio Equality Act onto the President's desk for signature.

U.S. Reps. Don Manzullo (R-IL) and Jay Inslee (D-WA) today introduced bipartisan legislation to protect Internet music Web casters from unfair government regulations that threaten to put them out of business and end the access to music over the Internet for more than 70 million Americans.

The Internet Radio Equality Act would reverse a recent decision of the federal Copyright Royalty Board (CRB) to at least triple the amount of royalties Internet radio broadcasters pay to copyright holders for playing a song.

The Death of Internet Radio is Imminent

Artists will be losing money and exposure

The Copyright Royalty Board (CRB) turned down the webcasting community's request for a rehearing on broadcast royalty rates. On May 15, 2007 the new rates go into effect, not only for 2007 but the rates are retroactive for 2006.

The rates will not allow internet radio to continue. They are just too much. Most estimates reveal that the required royalties will exceed gross revenues of internet radio businesses. Combine that with the retroactive royalties for 2006, many people actually face bankruptcy.

How could all of this happen? It just doesn't seem possible does it. Basically what is happening is the big record labels are shutting down internet radio by virtue of the lousy laws that regulate internet radio and the fact that they have the ear of the CRB and they have been able to make the webcasting community look like a bunch of schmucks that aren't paying what they should for playing music.

What is interesting is that terrestrial radio doesn't pay the same royalties that internet radio pays. Their royalty burden is paltry. And satellite radio pays a much, much lower rate than does internet radio.

All of this is pretty unbelievable, right? The large labels want the internet for themselves. They will open their own stations and use them as a point of sale opportunity for downloading and CD sales. Here's the rub. They won't have to pay any royalties to the artists. That's right. Currently internet radio pays Sound Exchange (a so-called non-profit company formed by the RIAA) royalties which, by statute, are distributed to both the label AND the artist. A record label that forms its own station is not under the same obligation to pay the artist as they control the copyright and can give themselves permission to play their own music royalty-free.

The way I see it is that the music companies don't have a clue and are putting the last nail into their coffin. They are screwing a listening audience of some 70 million people that listen to internet radio and they are screwing their artists by denying them royalty payments from internet radio. The artists have largely been silent about all of this and have refused to take a stand and now will not only be losing money but will be losing exposure of their music in a music-first environment that internet radio provides. Because of their inaction, I guess they are getting what they deserve.

What a plan. Good grief.

The only way that this is going to change is if the U.S. Congress steps in and takes action with legislation. But the RIAA has a lot of lobbyists and is very well connected in DC so the future isn't so bright.

Programming Note:

The Sound Cellar will be programming classic rock and some oldies until all of this CRB royalty thing shakes out to a resolution.

We will have some specialty programming at various times - maybe even a live broadcast or two...

We are incredibly bummed out about the internet radio and CRB royalty rates situation, including the lack of artist support of internet radio, so we are somewhat abandoning our mission of playing excellent music, from a wide variety of artists that we love, that is not heard on terrestrial radio.

Thanks to everybody that listened to our live broadcasts during The Blizzard of 2007. We had a blast. The eyewitness blizzard reports from our intrepid Weaterbabe were definitely the highlight of the broadcasts. It's pretty unbelievable how many fans she has.

We are contemplating doing a weekly live broadcast of two hours based upon a theme of some sort. Being free form, the theme could be based upon just about anything. We'll post more information when we get it all figured out.

John Hammond - Featured Artist for February

There's nothing like listening to John Hammond to take the chill off of a cold winter's night. And, John's new album, "Push Comes to Shove," produced by G. Love and John's wife Marla, will melt the frost right off the window.

John is one of our favorite artists here at The Sound Cellar. We've been spellbound by his blues since the first day we dropped a needle on his album "Big City Blues." We haven't been the same since we first witnessed a live performance of John playing his timeless blues.

John Hammond is a treasure. He is the consummate gentleman troubadour traveling the world spreading the gospel of the blues to all who are willing to lend an ear and take his message to heart. The world is a better place thanks to all of the years the John has been preaching his blues and by the looks of things, he's not going to be slowing down any time soon.

After performing this past summer at his alma mater Antioch College, we had chance to chat with him about his new album where he mentioned that G. Love was producing it. He was visibly excited about the sessions and very pleased with the resulting recordings. It's easy to understand his excitement. "Push Comes to Shove" stands among the best work of his career, and if you know anything of John's extraordinary career, that's making a bold statement.

The Sound Cellar will be featuring as much John Hammond music as the Digital Millenium Copyright Act will allow. All month we'll be playing cuts from "Push Comes to Shove" and more from John's expansive catalog. And, the playlist will be taking on a decidedly more bluesy feel as we do our part to spread the gospel of the blues this February.

Hank Williams Jr. is celebrating the 25th Anniversary of his classic track "A Country Boy Can Survive" with a remastered and remixed version of the song. This legendary cut is as relevant today as it was when written back in 1981 and remains a staple on radio. The song and artist bridge generations -- in just 4 weeks, it has generated 250,000 plays on MySpace. A video for the song had never been shot -- until now --and is set to premiere on CMT in mid-January.

The show was recorded on Halloween eve at The Forum in London, England and has been traded between collectors ever since. You see, while the fans already knew that Hiatt was a brilliant songwriter, his work on the road with The Guilty Dogs showed everyone that the songs had bite, too.
